Terms of Service

These Terms govern your use of Stimafy (“the Service”, “we”, “us”), a web application that helps landlords in Kenya track sub-meter readings, calculate per-tenant electricity bills using KPLC tariffs, and send invoices via WhatsApp. By creating an account or otherwise using the Service, you agree to these Terms.

1. Who can use Stimafy

You must be at least 18 years old and legally able to enter contracts in your jurisdiction. You must have the right to manage the properties, units, and tenant relationships you record in the Service.

Stimafy uses Google Sign-In via Amazon Cognito. You are responsible for the security of the Google account you use to sign in, and for any activity that occurs under your Stimafy account. Notify us at support@stimafy.online if you suspect unauthorised access.

You decide what to enter into Stimafy: properties, units, tenant names, meter readings, bills. Stimafy stores and processes that data on your behalf as your Data Processor (see our Data Processing Agreement). You are the Data Controller and are responsible for:

5. Bills, payments, and WhatsApp delivery

Stimafy calculates bill amounts using readings you enter and the rate derived from the KPLC SMS you provide. We do not collect or hold money on your behalf. Tenants pay you directly, by whatever means you arrange (M-Pesa, cash, bank).

When you click “Send via WhatsApp”, your browser opens WhatsApp on your device with an invoice message pre-filled. The message is sent from your WhatsApp account, not from a Stimafy server. We do not see whether the message was delivered or read.

6. Pricing and availability

Stimafy is currently in beta and free to use. We may introduce paid plans in the future; you will be notified by email before any charges apply.

The Service is provided on a best-effort basis. We do not offer a formal uptime SLA during beta. Aurora Serverless v2 scale-to-zero means the first request after a quiet period may take up to 30 seconds to respond as the database wakes up.

7. Termination

You may stop using Stimafy at any time. To request deletion of your landlord account and all associated data, email support@stimafy.online.

We may suspend or terminate accounts that violate these Terms, or that appear to be used for fraud, abuse, or illegal activity.

8. Limitation of liability

Stimafy is provided “as is” without warranties. To the maximum extent permitted by Kenyan law, we are not liable for indirect, consequential, or incidental damages arising from your use of the Service. Our total liability in any matter is limited to the fees you have paid to us in the prior twelve months (KES 0 during beta).

Disputes with tenants over bill amounts, meter accuracy, or payment terms are between you and your tenants. Stimafy provides the calculation tool, not a legal arbiter.

9. Governing law

These Terms are governed by the laws of Kenya. Any dispute that cannot be resolved amicably will be referred to the courts of Kenya.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and update the “Last updated” date above. Continued use of the Service after such changes means you accept the updated Terms.
